Who these terms are with
You're agreeing with NightFlareProduction (NFP), an independent project based in Prague, Czech Republic. "Velio", "we", "us", and "our" refer to NFP. "You" and "your" refer to anyone using this site, joining the waitlist, or using the Velio app once it ships. By using any of those, you agree to what's on this page.
If you don't agree with something here, the right move is not to use Velio. Reach out at velio.app@proton.me if something is unclear.
What Velio is (and isn't)
Velio is a calm daily companion for health, mindset, and planning. It helps you reflect, set intentions, log meals, journal, and notice patterns over a week. It runs on iOS.
The journal prompts, food log, mood tracking, focus modes, and weekly reviews exist to help you reflect on your own patterns. They are not clinical interventions and they don't diagnose, treat, cure, or prevent any condition.
If you have concerns about your physical or mental health, or about food, sleep, or substance use, talk to a qualified professional. If you are in crisis, contact your local emergency services or a mental health helpline. Velio is not built to respond to emergencies.
Eligibility
You need to be at least 16 years old to use Velio. That's the GDPR threshold for consenting to data processing on your own; if you're younger, the app isn't for you yet.
While Velio is in development phase (today)
Right now there's no app to install officialy. The only thing on offer is the waitlist on velioapp.netlify.app. By submitting your email there, you're asking us to email you when Velio launches. That's the entire scope of the arrangement at the moment. We'll send you one launch email plus, at most, an occasional meaningful update before then.
You can ask us to remove your email from the list at any time by writing to velio.app@proton.me. No questions asked.
Once Velio ships — your account
When the app launches, using its full features will require a Velio account. You're responsible for keeping your login credentials private and reasonably secure. One account per person; please don't share accounts with friends, family, or the internet at large.
If you suspect someone else is using your account, email us immediately at velio.app@proton.me.
Acceptable use
Most of this is common sense, but to be explicit: please don't
- try to break, hack, or reverse-engineer the app
- use the app to harass, deceive, or harm anyone — including yourself, in ways the app obviously isn't built to handle
- scrape, copy, or republish the app's content, design, copy, or proprietary text (journal prompts, focus-mode descriptions, weekly review summaries)
- use Velio for any unlawful purpose under Czech, EU, or your local law
- impersonate another person when creating an account
- resell, rent, or sublicense access to the app
We can suspend or terminate accounts that abuse these. We'll try to explain why before doing so where it's safe to do that.
Velio Premium — when it launches
The Velio app will always have a free tier. Some features — AI-driven photo nutrition recognition, the Velio additional quotes & journal questions — will be part of an optional paid tier called Velio Premium.
Premium pricing, when it goes live, is expected to be:
- $3.99 per week, or $99 per year (annual is roughly 52% cheaper than weekly)
- 14-day free trial when you start
- Cancel any time from your iOS subscription settings
Billing for Premium will be handled through Apple's App Store, not directly by NFP. That means refunds, cancellations, and payment disputes go through Apple standard processes — we don't have access to your card details and can't refund you directly. Their refund policies apply.
What you own, what we own
Your content stays yours
Anything you put into Velio — journal entries, food logs, intentions, mood selections, photos — remains yours. You retain all rights to your content. We do not claim a perpetual license to publish, sell, or train models on what you write.
To make the app work, you grant us a limited, non-exclusive, non-transferable licence to store, sync, and display your content back to you on your devices. That licence ends when you delete the content or your account.
Velio itself stays ours
The Velio app, its design, source code, copy, illustrations, brand marks, and the proprietary journal prompts and weekly-review narratives are all owned by NFP. Velio is closed-source software; what you receive is a non-exclusive, non-transferable licence to use the app on your devices, not the source code itself.
Disclaimers
Velio is provided "as is", with no warranty of any kind, express or implied. We try hard to make the app reliable and pleasant, but we can't guarantee it'll be uninterrupted, error-free, or fit for any particular purpose you have in mind.
Where the app surfaces health-related information from Apple HealthKit, we display what those systems give us — we don't independently verify that data and we can't guarantee its accuracy.
Limitation of liability
To the fullest extent permitted by Czech law, NFP's total liability to you for any claim arising from your use of Velio is limited to the greater of (a) the fees you paid us in the twelve months before the claim arose, or (b) €50. We're not liable for indirect, incidental, consequential, or punitive damages, or for lost profits, data, or goodwill.
Nothing in these terms limits liability where Czech or EU law doesn't allow it to be limited — for example, fraud, gross negligence, or harm caused intentionally.
Termination
You can stop using Velio at any time. Deleting your account in the app removes your content from any device sync within thirty days, and removes your email from any waitlist or transactional list within a reasonable time after that.
We can suspend or terminate your access if you materially violate these terms, if we're required to by law, or if NFP decides to wind down Velio entirely. In the wind-down case we'll give reasonable notice and provide an export of your content where technically possible.
Changes to these terms
We may update these terms over time — to reflect new features, new legal requirements, or simply to make them clearer. The "last updated" date at the top of this page reflects the most recent change. For changes that materially affect your rights, we'll email you and announce it in the app before the change takes effect.
If you don't agree with an update, the appropriate response is to stop using Velio. Continuing to use the app after a material change counts as accepting the updated terms.
Governing law
These terms are governed by the laws of the Czech Republic. Any dispute that can't be resolved by writing to velio.app@proton.me first will go to the competent courts in Prague. If you're a consumer based in another EU country, this choice of court doesn't override your right to bring a claim in your home country's courts under EU consumer protection rules.
